How to file an animal-cruelty case

Report active cruelty immediately.

Call barangay officials and/or police at 911. Posting, tagging PAWS, or asking social-media users to intervene is not an official report.

Gather evidence

The animal may be the most compelling evidence. If confiscation is not possible, photos, videos, original files, witness accounts, and veterinary findings strengthen the complaint.

Prepare the documents

Organize affidavits, IDs, official incident records, media evidence, and veterinary documentation around a clear chronology.

Sign the PAWS agreement

Qualified complainants and primary witnesses commit not to back out after PAWS begins shouldering legal expenses.

Testify in court

Successful prosecution depends on citizens who are prepared to appear, tell the truth, and remain engaged through the legal process.

Tell the facts

What the affidavit must establish

Who

Complete names of the people involved and the witness’s basis for identification.

When & where

Date, approximate time, exact location, and relevant sequence.

What happened

A detailed, chronological description based on direct observation.

Preserve credibility.

Separate personal observation from what another person told you. Do not exaggerate. The witness may be questioned under oath.

What PAWS support means

PAWS offers free legal assistance to pet owners and concerned citizens who want to pursue legal action and meet program conditions. Acceptance is not automatic. The submission must be reviewable, supported, and backed by people willing to continue.

RA 8485

Animal Welfare Act of 1998

The law promotes animal welfare and regulates facilities used to breed, keep, treat, trade, or train animals. Section 6 makes acts such as torture, maltreatment, and failure to provide adequate care, sustenance, or shelter unlawful. It also addresses animal fighting, unauthorized research, cruel transport, and humane procedures.

Animal Welfare Act Amendment of 2013

The amendment expressly includes animals’ physical and psychological well-being, makes abandonment unlawful, strengthens enforcement, and creates graduated penalties based on harm. It also provides aggravated penalties when the offender is a syndicate, profits from cruelty, is a public officer or employee, or the offense involves at least three animals.
